Overview

Colby Keefe is a member of Henderson Franklin’s Real Estate Department and focuses her practice on community association law. She assists communities on issues ranging from covenant enforcement, governing document interpretation and revisions, and land use governance to matters of compliance with the Fair Housing Act. Her experience also includes collection matters, lien foreclosures, and preparing and negotiating vendor contracts. Colby is admitted to practice in all Florida state courts.

For Colby, practicing in community association law is exciting and brings variety to her practice. Working alongside and providing continuing education courses and counsel to managers and Boards of Directors is intellectually rewarding as she has an opportunity to provide a detailed, yet understandable, analyses of legal questions.

As a member of the Community Association Institute, Colby has learned that genuine connections along with savvy marketing techniques foster growth both for her clients as well as community association operations at large. The Florida Association for Women Lawyers (FAWL) named Colby a “Leader in Law” in 2020. She was published in the FAWL Journal for her discussion on gender politics and the use of campaign finances on childcare expenses incurred by candidates. In 2023, Naples Illustrated recognized Colby as a “Top Lawyer” in the field of Real Estate law. Colby is also a contributor to the Legal Scoop on Southwest Florida Real Estate blog. While a student at the University of Georgia School of Law, Colby acted as a notes editor on the Journal of Intellectual Property. More recently, she is a past president of the St. Johns Association for Women Lawyers (“St. JAWL”). In this role, Colby taught continuing education courses for attorneys on topics such as women in politics and political gender gaps.

Colby is an Englewood, Florida native. She’s proudly a first-generation attorney and graduate of the Take Stock in Children program of Charlotte County. Colby enjoys crafting cards, playing frisbee with her dog, Duke, reading, and watching college football.

Professional and Civic Affiliations

Colby was a graduate of the Greater Fort Myers Chamber of Commerce Leadership Class of 2022. She is a member of the South Gulf Coast chapter of the Community Association Institute (CAI) and the Lee County Bar Association. She was previously an advisory committee member of the St. Johns County Take Stock in Children Scholarship Program and volunteered for the St. Johns County Legal Aid pro bono clinic.

Representative Matters

  • Assisted in settlement of claim brought under Bert J. Harris Act which enabled client to develop approximately 5,000 acre land in Lee County, Florida
  • Licensed by the Florida Department of Business and Professional Regulation to teach continuing education courses to CAMs and board members on various community association topics

Prior to joining Henderson Franklin

  • Recovered approximately $75,000.00 of past-due expenses from neighboring parcels on behalf of homeowners association for contribution toward operation and maintenance of shared storm water management system.
  • Represented condominium association in negotiating a conditional rezoning ordinance with developer-applicant, which resulted in extensive list of prohibited uses of the neighboring parcel and mitigated impact of development on condominium association and its residents.
  • Successfully negotiated recovery in excess of $10,000.00 from tax deed surplus on behalf of a homeowners association, despite competing claim of first mortgage superior lien holder and extinguishment of association’s junior claim of lien.
